跟进：司法部撤回加州选票案：邦塔称联邦政府四度败诉后放弃诉讼

加利福尼亚州总检察长罗布·邦塔（Rob Bonta）11月6日在奥克兰宣布，联邦政府已撤回一宗诉讼，不再要求加州选举官员把一份约2万人名单上人员可能投出的邮寄选票单独存放、不予计票。联邦司法部称这份名单上的人员「很可能」是非公民。

邦塔办公室表示，联邦政府是在连输四场官司之后主动撤诉的；若不撤诉，下周五、即11月13日，它原本要在联邦法官戴维·卡特（David Carter）面前出席一场法院下令的证据听证会，就这份名单是否可靠接受审查。其他案件的法庭曾对类似名单的可靠性表示担忧，司法部一名律师在另一宗案件中也曾承认，其名单「错误率很高」。

邦塔说：「下周，特朗普政府原本要在法庭上就其疑似非公民名单面对尖锐质问。它没有接受这场审查，而是选择撤案。」「一周之内连败四场、包括在美国最高法院败诉之后，联邦政府现在认输了。加州立场坚定并胜诉，全国选举结果也清楚表明，美国民众压倒性地拒绝特朗普政府的反民主议程。加州将永远捍卫我们的民主与法治。」

四次驳回的时间线如下：10月26日周一，美国第九巡回上诉法院驳回联邦政府试图绕过地区法院提出的第一次紧急上诉；10月28日周三，美国加利福尼亚中区联邦地区法院驳回联邦政府的临时限制令请求；10月30日周五，第九巡回上诉法院驳回其在上诉待决期间的紧急禁令动议；11月2日周一，美国最高法院驳回其紧急申请，该申请要求强迫加州选举官员把涉案邮寄选票单独存放、不予计票。

Follow-Up: Justice Department Drops California Ballot Lawsuit; Bonta Says Federal Government Gave Up After Four Court Losses

California Attorney General Rob Bonta announced in Oakland on November 6 that the federal government has dropped a lawsuit that sought to force California election officials to set aside and not count mail-in ballots that may be cast by people on a list of approximately 20,000 individuals the U.S. Department of Justice believes are likely noncitizens.

Bonta's office said the Department of Justice chose to voluntarily dismiss its case after four consecutive court losses, rather than face a court-ordered evidentiary hearing before Judge David Carter next Friday, November 13, to scrutinize the reliability of its list. Courts in other cases have raised concerns about the reliability of similar lists, and a Department of Justice attorney in another case recently acknowledged that its lists have a high error rate.

"Next week, the Trump Administration would have faced tough questions in court about its list of suspected noncitizens. Rather than face that scrutiny, it chose to drop its case," Bonta said. "After four court defeats in just one week, including at the U.S. Supreme Court, the federal government has now thrown in the towel. California stood firm and prevailed, and the nationwide election results made clear that Americans overwhelmingly reject the Trump Administration's anti-democratic agenda. California will always stand up for our democracy and the rule of law."

Bonta's office said the U.S. Constitution gives States and Congress, not the President or the Executive Branch, the authority to regulate the time, place, and manner of elections, and that the Administration's repeated attempts to undermine that constitutional authority were decisively rejected by four courts in one week.

The timeline of the four rejections is as follows: on Monday, October 26, the U.S. Court of Appeals for the Ninth Circuit dismissed the federal government's first emergency appeal after it attempted to bypass the district court; on Wednesday, October 28, the U.S. District Court for the Central District of California denied the Administration's request for a temporary restraining order; on Friday, October 30, the Ninth Circuit denied its emergency motion for an injunction pending appeal; and on Monday, November 2, the U.S. Supreme Court rejected its emergency application seeking to force California election officials to segregate and not count the mail-in ballots at issue.

The dismissal is the latest development in the California voter-list litigation that GSM has been following; earlier developments are listed in the event timeline on this page.
