Peltola Campaign Sues Alaska Elections Division for Records on Rejected Absentee Ballots

ANCHORAGE, Alaska — The campaign of Democratic U.S. Senate candidate Mary Peltola sued Alaska election officials on Friday, November 6, seeking the immediate release of records identifying absentee ballots that were rejected in Tuesday's voting.

Alaskans for Mary filed the suit in Anchorage Superior Court against Lt. Gov. Nancy Dahlstrom, Elections Director Carol Beecher and the Alaska Division of Elections, asking a judge to order the release of records showing which absentee ballots were flagged for rejection and why. The campaign also sought a temporary restraining order and a preliminary injunction to compel prompt disclosure.

According to the complaint, the campaign requested the records on October 27 and again on Wednesday under Alaska's Public Records Act but received no response, and state attorneys declined on Thursday to turn them over immediately. The campaign argues that without prompt access it cannot monitor whether ballots are being properly counted or determine whether its supporters' ballots were improperly rejected.

The state Department of Law responded that the Division of Elections has long treated those records as confidential and that Alaska law does not require their release. The division has said the records are preliminary and could give the campaign information about individual ballots before the affected voters can see it themselves.

Peltola and incumbent Republican Sen. Dan Sullivan remain locked in a close contest, with about 600 votes separating them as ballots from remote areas were still being counted, according to Associated Press and Decision Desk HQ tallies on Friday evening. The state will accept ballots up to November 18.

The race has already been roiled by controversy: an independent candidate named Daniel J. Sullivan appeared on the ballot alongside the senator, and President Donald Trump demanded that the 3,600 votes cast for the namesake candidate be awarded to Sen. Sullivan. The Justice Department sued to delay certification if Sullivan lost by less than the namesake's vote share; a federal judge threw that lawsuit out.
