Florida's Second District Court of Appeal Rules on November 4 That the State's Teen-Safety Lawsuit Against Meta Cannot Be Dismissed Early
A three-judge panel of Florida's Second District Court of Appeal ruled on November 4 against Meta's bid to have the Florida attorney general's lawsuit dismissed early, allowing the state's teen-safety case against Meta to proceed. The opinion was written by Judge Andrea Teves Smith and joined by Judges Robert Morris and Suzanne Labrit.
According to the Tallahassee Democrat's November 4 report, Meta is the parent company of Instagram. Meta had argued that Florida officials were violating its First Amendment free-speech rights, but in the 19-page order the panel said Meta had not proved any violation, and that Meta's speech and expression rights had in fact not been limited in any way.
Attorney General James Uthmeier's lawsuit accuses Meta of addicting children to social media through harmful product design, including features such as infinite scroll. The case is one of several the attorney general has brought against online companies; Uthmeier has also proposed the Safe Screens Act, which would impose protective default settings and age verification on social media accounts of users aged 14 to 17.
