韩国产业部拟扩大技术泄密犯罪收益没收范围 涵盖国内泄密与一般产业技术
据韩国媒体10月19日报道，韩国产业通商资源部拟大幅扩大技术泄密犯罪收益的没收范围。现行制度下，只有向海外泄漏国家核心技术并获利的个案，犯罪收益才会被没收；新方案计划将适用范围扩大至国内泄密，并涵盖全部产业技术，而不限国家核心技术。产业部计划于今年内发布《产业技术泄密防止及保护综合计划》后续方案，作为强化技术保护体系的一环。产业部表示，近年来产业技术外泄案件持续增加，半导体、显示器、二次电池等韩国主力产业成为主要目标，现行以刑罚为主的处罚对犯罪的吓阻作用有限，透过没收犯罪收益切断经济诱因尤为重要。韩国现行《产业技术保护法》对将国家核心技术泄漏至海外者设有重罚，但实务上犯罪所得的追缴适用面狭窄。产业界对此方向多表支持，认为技术保护攸关国家竞争力；具体修法与执行细节仍待产业部正式公布。
South Korea to Expand Confiscation of Criminal Proceeds from Technology Leaks to Domestic Cases and All Industrial Technology
South Korea's Ministry of Trade, Industry and Energy plans to significantly expand the scope for confiscating criminal proceeds from technology leaks, Korean media reported on Oct. 19. Under the current system, proceeds can be confiscated only in cases where national core technology is leaked overseas for profit; the new plan would extend this to domestic leaks and to all industrial technologies, not just designated national core technology. The ministry intends to publish the follow-up measures under its comprehensive plan for preventing and protecting against industrial technology leaks within this year. Officials said technology-leak cases have kept rising, targeting Korea's flagship industries such as semiconductors, displays and rechargeable batteries, and that punishment centred on prison terms has limited deterrent effect, making it essential to cut off the economic incentive by seizing illicit gains. Korea's Industrial Technology Protection Act imposes heavy penalties for leaking national core technology abroad, but the seizure of criminal proceeds has applied only narrowly in practice. Industry groups generally welcomed the direction; details of amendments and enforcement await the ministry's formal announcement.
