柯克案法官裁定：被告若加重谋杀成立仍可判死刑
犹他州犹他县，审理保守派活动人士查理·柯克遇刺案的法官10月30日作出裁定：被告 Tyler Robinson 如果被判加重谋杀罪成立，仍可能面临死刑，辩方要求取消死刑选项的动议被驳回。
主审法官 Tony Graf 同时裁定，犹他县副检察官 Christopher Ballard 因就案件证据强度发表个人看法、违反法院禁言令，构成民事藐视法庭；但 Ballard 就辩方文件中有关弹道证据的误导性说法所作的澄清，并未违反法院命令。
Graf 表示，取消死刑作为对藐视法庭行为的补救“极不相称且在法律上不可行”，可通过扩大陪审团遴选程序、加强筛选与提问来保障审判公正。检方此前辩称，他们是在辩方文件引发网络报道、暗示联邦烟酒火器局无法将杀害柯克的子弹与嫌疑枪支匹配后“澄清记录”，并遵守了禁言令与全部法院规则。
柯克2025年9月10日在犹他谷大学的一场活动上遇刺身亡，Robinson 被控加重谋杀等罪名。法官表示，下一次听证定于11月9日，届时将继续处理案件日程问题。
Judge Rules Kirk Case Defendant Still Faces Possible Death Penalty
UTAH COUNTY, Utah — The judge presiding over the case of the man accused of assassinating conservative activist Charlie Kirk ruled October 30 that defendant Tyler Robinson still faces a possible death sentence if convicted of aggravated murder, denying the defense motion to remove the death penalty as an option.
Judge Tony Graf also ruled that Utah County Deputy Attorney Christopher Ballard committed civil contempt by violating the court's gag order when he offered personal views on the strength of the evidence — but that Ballard's clarification of what he called misleading defense claims about ballistics evidence did not violate the court's orders.
Graf said removing the death penalty as a remedy for the contempt would be "grossly disproportionate and legally untenable," and that trial fairness can be protected by expanding jury selection with enhanced screening and questioning. Prosecutors had argued they were "setting the record straight" after defense filings prompted online reports suggesting the ATF could not match the bullet that killed Kirk to the suspect rifle, and that they complied with the gag order and all court rules.
Kirk was shot and killed on September 10, 2025, during an event at Utah Valley University. Robinson is charged with aggravated murder and other counts. The judge set the next hearing for November 9 to continue addressing scheduling.
