美国联邦量刑指南修订11月1日生效：诈骗损失门槛十余年来首次上调
美国量刑委员会（United States Sentencing Commission，USSC）修订的联邦量刑指南于11月1日正式生效。这套修订将改变全美联邦法院在诈骗、毒品与多项定罪等案件中计算建议量刑区间的方式。
量刑委员会2026年4月16日在华盛顿宣布，委员会以全票通过这一揽子修订。修订于4月30日送交国会，国会未采取行动，遂按委员会官方文本所定日期于11月1日生效，修订官方文本已刊载于5月4日出版的《联邦公报》。
经济犯罪部分是此次修订中数字变化最明确的一项：用于计算诈骗、盗窃等案件量刑等级的损失金额表十余年来首次按通货膨胀调整，起步门槛由6,500美元提高到9,000美元，最高一档的门槛由5.5亿美元提高到7.5亿美元。门槛上调意味着同等金额的诈骗损失在新指南下对应的量刑等级低于旧表。
毒品部分落实《HALT芬太尼法》（HALT Fentanyl Act）：芬太尼相关物质被永久列入《受控物质法》第一类管制，并写入指南的药物数量表，量刑时原则上按芬太尼类似物的数量门槛处理；被告如能证明涉案物质效力明显较低、或能抵消芬太尼的作用，可对此提出挑战。
其余修订包括：简化多项定罪合并计算建议量刑的办法，以促进适用一致、减少诉讼；更明确地划清缓刑、罚金与监禁三种量刑选项的适用，协助法官裁量；删去二十余项很少或从未被适用的具体犯罪特征，其中一些可追溯到1987年出版的首版《量刑指南手册》。
量刑委员会主席、联邦法官 Carlton W. Reeves 表示，委员会感谢法官、缓刑官、执业者、倡导组织与在押人员等各方提交的数千页公众意见，「今天这些常识性的良好治理修订，正是得益于这些宝贵反馈以及委员会的量刑数据」。

Revised Federal Sentencing Guidelines Take Effect November 1: Fraud Loss Thresholds Raised for First Time in Over a Decade
Revised federal sentencing guidelines adopted by the United States Sentencing Commission (USSC) took effect on November 1, changing how federal courts across the United States calculate advisory sentencing ranges in fraud, drug and multiple-count cases.
The commission announced in Washington on April 16, 2026, that it had adopted the package in unanimous votes. The amendments were delivered to Congress on April 30, and, absent congressional action, took effect on November 1 as specified in the commission's official text, which was published in the May 4, 2026, edition of the Federal Register.
The clearest numerical change concerns economic crime: the loss table used to set offense levels in fraud and theft cases was adjusted for inflation for the first time in more than a decade, with the first enhancement threshold rising from $6,500 to $9,000 and the top threshold rising from $550 million to $750 million. The higher thresholds mean a given dollar loss now maps to a lower offense level than under the old table.
The drug amendment implements the HALT Fentanyl Act: fentanyl-related substances are permanently placed in Schedule I under the Controlled Substances Act and added to the guidelines' drug quantity table, where they are generally sentenced at the same quantity thresholds as fentanyl analogues, subject to a defendant's showing that a substance is significantly less potent or counteracts fentanyl's effects.
Other amendments streamline how guidelines account for multiple counts of conviction to promote more consistent application and reduce litigation, more clearly delineate when probation, a fine or imprisonment is the appropriate sentence, and eliminate more than two dozen specific offense characteristics that are rarely or never applied, some dating back to the original 1987 Guidelines Manual.
Commission Chair Judge Carlton W. Reeves said the commission was grateful for the thousands of pages of public comment received from judges, probation officers, practitioners, advocacy organizations, incarcerated individuals and others, and that the common-sense, good-government amendments were informed by that feedback and by the commission's sentencing data.
The Sentencing Commission is an independent agency within the federal judicial branch, with bipartisan membership, that sets the advisory guidelines federal judges consult when imposing sentences. The amendments apply to federal cases sentenced on or after November 1.
