商品期货交易委员会发布公正准入解释：指定合约市场须取消国内地域限制
美国商品期货交易委员会（CFTC）11月5日发布一项解释，就指定合约市场（DCM）须向其会员与享有交易特权者提供竞争性、开放、公平与公正准入的要求作出澄清；该「公正准入要求」载于委员会规章第38.151(b)条。
按该解释，与公正准入要求相抵触的国内地域限制须在30天内取消；指定合约市场若无法在期限内合规，须向 CFTC 市场监督司提交说明，解释不可行的原因，包括其交易中介环节无法在期限内配合调整的情形。CFTC 主席 Michael S. Selig 表示，衍生品市场必须在全国范围内以统一方式运作，才能实现《商品交易法》设定的目标。指定合约市场是经联邦注册、可进行期货及其他衍生品交易的交易所，其准入标准须透明并以非歧视方式适用。

CFTC Issues Impartial Access Interpretation: Designated Contract Markets Must End Domestic Geographic Restrictions
The Commodity Futures Trading Commission (CFTC) on November 5 issued an interpretation of the requirement that designated contract markets (DCMs) provide competitive, open, fair, and impartial access to their members and persons with trading privileges. The impartial access requirements are set out in Commission Regulation 38.151(b).
Under the interpretation, domestic geographic restrictions that run afoul of the impartial access requirements must be removed within 30 days. A DCM that cannot comply within that window must submit an explanation to the CFTC's Division of Market Oversight laying out why compliance is not feasible, including where its intermediaries cannot be brought into line in time. CFTC Chairman Michael S. Selig said derivatives markets must operate on a uniform basis at a national scale in order to achieve the purposes set out in the Commodity Exchange Act. Designated contract markets are the federally registered exchanges on which futures and other derivatives trade in the United States, and their access criteria must be transparent and applied in a non-discriminatory manner.
