国际法院定于11月19日就缅甸罗兴亚种族灭绝案宣判
荷兰海牙消息，国际法院 11 月 3 日星期二宣布，将于 11 月 19 日就冈比亚诉缅甸政府的罗兴亚种族灭绝案作出判决，法官将于格林尼治时间 11 月 19 日 8 时开始宣读判决书。这是十多年来国际法院首次、历史上第三次就种族灭绝案件作出判决。
此案由冈比亚于 2019 年提起。冈比亚主张，缅甸政府军 2017 年的军事行动构成种族灭绝，迫使至少 73 万罗兴亚人逃往邻国孟加拉国。罗兴亚难民讲述了杀戮、大规模强奸与纵火的情况，联合国实况调查委员会也得出结论，认为这次行动包含“种族灭绝行为”。缅甸否认种族灭绝指控，称当时的行动是合法的反恐行动。
国际法院是联合国的最高法院，审理国家间争端与违反包括 1948 年《防止及惩治灭绝种族罪公约》在内的国际条约的指控。路透社报道，这一判决结果可能影响国际法院今后的种族灭绝案件，包括南非 2023 年指控以色列在加沙实施种族灭绝的案件，以色列对此予以否认。国际法院的判决为终审，不得上诉。
World Court to Rule in Rohingya Genocide Case on 19 November
THE HAGUE, Netherlands — The International Court of Justice will rule on 19 November in its landmark case against the government of Myanmar, which is accused of committing genocide against the minority Muslim Rohingya, the court said on Tuesday. ICJ judges will start reading out their judgment on 19 November at 8:00 GMT. It will be the first time in over a decade, and only the third time ever, that the ICJ hands down a judgment in a genocide case.
The case was brought by Gambia in 2019. Gambia argued that a 2017 offensive by Myanmar government forces that forced at least 730,000 Rohingya into neighbouring Bangladesh constituted a genocide. Rohingya refugees recounted instances of killings, mass rape and arson, and a UN fact-finding commission concluded the offensive included "genocidal acts." Myanmar denies accusations of genocide and has said the offensive was a legitimate counter-terrorism campaign.
The ICJ is the UN's highest court and deals with disputes between states and alleged breaches of international treaties including the 1948 Genocide Convention. Reuters reported that the outcome is likely to shape future genocide cases at the ICJ, including South Africa's 2023 case accusing Israel of committing genocide in Gaza, a charge Israel denies. ICJ rulings are final and without appeal.
