加州上诉法院裁定：城市拖延ADU许可 屋主可索赔

法律界人士指出，这一逻辑可能不止适用于 ADU，也可能延伸到其他依法必须简易审批的住房项目。对加州各城市而言，拖延审批从此可能有了明码标价的代价。
California Appeals Court: Homeowners May Seek Damages When Cities Stall ADU Permits
LOS ANGELES — A California appeals court has opened a new path for homeowners to sue cities that stall backyard-home permits. In a published decision issued October 23, the Second District Court of Appeal ruled that Palos Verdes Estates homeowner Wei Shi may pursue damages over an alleged three-year delay in approving his accessory dwelling unit (ADU), reversing a Los Angeles County judge who had dismissed the suit.
Shi applied in 2020 to build an ADU beside his home. According to the lawsuit, the city required a conditional use permit, discretionary review and approval from the local homes association's art jury, and the permit was not issued until 2023. Shi claims losses exceeding $1 million, including higher construction costs, interest, design fees, lost use of the property and diminished value.
California law (Government Code section 66317) requires local governments to act on complete ADU applications through ministerial review within 60 days. The court held that ADU applicants are the "direct and intended beneficiaries" of that mandatory duty, and that a homeowner may seek damages under section 815.6 of the Government Claims Act when a city breaches it. The court stressed that Shi has not won anything yet: he must still prove the delay caused his losses, and the city may raise defenses, including reasonable diligence.
Legal analysts note the logic could extend beyond ADUs to other ministerial housing approvals — putting a price tag on bureaucratic delay for cities across California.
