New Hampshire Supreme Court Upholds Revocation of Concord Casino's Charitable Gaming License in October 28 Ruling
On October 28, 2026, the New Hampshire Supreme Court ruled to uphold the state Lottery and Gaming Commission's orders revoking the Concord Casino's charitable gaming license and refusing to license the buyer found by former state senator Andy Sanborn. In Appeal of Win Win Win, LLC (2026 N.H. 40, consolidated cases 2024-0722 and 2024-0723), the court affirmed both sets of the commission's orders.
The commission had previously ordered the sale of Win Win Win, LLC, which operated as the Concord Casino, after finding credible evidence that the company and Sanborn had unlawfully obtained a federal disaster-relief loan, and it revoked the company's license in November 2024. The court upheld the denial of the buyer, citing Sanborn's continuing ties to the transaction and a closing payment more than ten times the buyer's cash on hand.
Sanborn pleaded guilty in July to a federal charge of theft of government funds and is awaiting sentencing in December, while a separate state case remains pending. The ruling confirms that regulators hold discretion over the suitability of both sellers and buyers; for Sanborn, the license fight is now over, and only sentencing and the state case remain.
