New Jersey Adopts First-in-the-Nation Online Gambling Rule: Operators Must Use Player Data to Flag Problem Gambling
The New Jersey Attorney General's office announced on Oct. 20 that the state has become the first in the nation to impose mandatory, data-driven responsible gaming requirements on online gambling operators. The new rule adopted by the Division of Gaming Enforcement (N.J.A.C. 13:69O-1.2A) requires online operators to use player behavior data to identify risk signals and intervene, covering trigger mechanisms, staged enforcement, marketing limits, withdrawal rules and record-keeping. The rule took effect Oct. 19. Attorney General Jennifer Davenport presented the new requirements at a news conference.
Industry media reported the attorney general also took aim at prediction-market platform Kalshi. New Jersey, which opened online gambling in 2013, has long been a national regulatory bellwether; the shift from promoted best practices to mandatory enforcement is being called a watershed for responsible gaming regulation in the U.S. gambling industry.
