Federal Judge Rejects Government Bid to Dismiss: NAACP's Air Pollution Suit Against xAI Moves Forward
U.S. District Judge Debra Brown of the Northern District of Mississippi ruled on Oct. 19 that the federal government may intervene in the NAACP's Clean Air Act citizen suit against Elon Musk's xAI, but has no authority to unilaterally dismiss the case, which will proceed. The NAACP and its Mississippi State Conference sued in April, alleging that xAI and its subsidiary MZX Tech built and operated a gas-fired power plant in Southaven to power the Colossus 2 data center without required environmental permits; the complaint initially identified 27 gas turbines, and a later preliminary-injunction filing alleged six more had been added.
The Trump administration moved in June to intervene on behalf of the EPA and sought dismissal, arguing that federal regulators hold primary enforcement authority under the Clean Air Act, and defending the plant on national security grounds — Defense Department official Cameron Stanley declared in the case that preserving xAI's data center capacity is a matter of paramount national security. Judge Brown rejected that reading, writing that by enacting the citizen suit provision, Congress plainly intended to let individuals sue even when federal and state governments decline to enforce the Clean Air Act. She also said the national security concerns were not relevant to the dismissal question. The ruling does not decide whether xAI violated the law; it resolves only who controls the case.
