Early Voting Opens on Houston's Proposition A: Lowest-Priority Marijuana Enforcement and a Ban on No-Knock Warrants

HOUSTON — Early voting opened October 19 in Houston, in Harris County, Texas, where voters will decide Proposition A, a city charter amendment, in the November 3 midterm election. If approved, the measure would require the Houston Police Department to make enforcement of Class A and Class B misdemeanor marijuana possession its lowest law-enforcement priority, with related reporting requirements, and would prohibit Houston officers from requesting or executing no-knock search warrants. Early voting runs through October 30.

Proposition A, also called the Houston Freedom Act, was placed on the ballot by the advocacy group Ground Game Texas, which gathered about 40,000 signatures. According to FOX 26, the measure would require officers serving warrants to knock, announce themselves and wait at least 15 seconds before entering. Its marijuana provisions also call for a one-time audit of five years of misdemeanor marijuana enforcement and annual public reports on arrests, citations, demographics and resources. Mayor John Whitmire has stayed largely neutral on the measure, saying marijuana possession is already not an HPD priority regardless of the outcome.

The no-knock provision traces to the January 2019 Harding Street raid, in which police obtained a no-knock warrant using an affidavit later found to be fabricated; homeowners Dennis Tuttle and Rhogena Nicholas were killed in the raid. HPD says it has not executed a no-knock warrant since an executive order in 2020. Supporters argue the ban should be written into the charter so it survives changes in department leadership, while critics argue judges should retain the option of approving such warrants in high-risk cases.

Approval would not legalize marijuana in Texas or in Houston: state law would remain unchanged, and only HPD's enforcement priorities and accountability rules would change. The measure would bind only the Houston Police Department, not the Harris County Sheriff's Office. In-person voters must present an accepted Texas photo ID, and polls on Election Day are open from 7 a.m. to 7 p.m. (GSM, based on FOX 26 Houston and the City of Houston's election notice)
