Arizona Attorney General Sues OpenAI Over ChatGPT Safety and Consumer Fraud Claims
Arizona Attorney General Kris Mayes filed a lawsuit against OpenAI in Maricopa County Superior Court on October 14, alleging that the super intelligence company violated the Arizona Consumer Fraud Act.
The complaint claims OpenAI concealed features that render the ChatGPT chatbot extraordinarily agreeable and uniquely sycophantic, drawing Arizonans, including minors, deeper into the platform to maximize their time spent on it. Mayes alleges the company prioritized profit over safety, using design tactics that push compulsive use among minors and override safety guardrails, and that the technology exposes minors to undisclosed serious harms, including reduced critical thinking skills, encouragement of paranoia or delusional thoughts, medical guidance and encouragement of unhealthy behaviors. The complaint also alleges the platform generated prompts that can be interpreted as encouraging self-harm or violence toward others, and encouraged minors to share personal information and withhold it from parents, family members or friends.
In a statement, Mayes said OpenAI put Arizona residents' safety at risk by failing to implement adequate user protections or transparency measures despite clear indications that minors regularly interact with its chatbot, and that Arizona is suing to protect Arizona children and hold the company accountable.
