蒙大拿州最高法院裁定县检察官有权就移民执法数据共享寻求裁决
蒙大拿州加拉廷县 Bozeman 消息：蒙大拿州最高法院11月6日就加拉廷县检察官与州总检察长的权限之争作出裁决，认定县检察官 Audrey Cromwell 有权就刑事司法信息共享问题向法院寻求宣告性裁决。
法院同时裁定，州总检察长 Austin Knudsen 对担任县法律顾问的县检察官不享有监督权，Knudsen 此前主张监督权并试图指令县检察官办公室法律意见的命令无法执行。争议源于今年4月联邦移民与海关执法局向加拉廷县索要文件，Cromwell 随后提出请愿，此前 Knudsen 曾试图直接指令县检察官办公室的法律意见，双方就此对簿公堂。
核心问题是各县能否在没有法院命令的情况下，向移民执法局提供机密刑事司法信息，以及移民执法局是否属于刑事司法机构。法院尚未就这一核心问题作出裁决，要求各方在2026年12月7日前提交书面意见，此后才会决定各县能否向联邦移民执法部门提供相关信息。

Montana Supreme Court Rules County Attorney May Seek Ruling on ICE Data Sharing
BOZEMAN, Montana — The Montana Supreme Court ruled on November 6 in a power dispute between the Gallatin County Attorney and the state attorney general, holding that County Attorney Audrey Cromwell has the right to ask a court for a declaratory judgment on criminal justice information sharing.
The court also held that Attorney General Austin Knudsen has no supervisory authority over county attorneys acting as county legal advisers, and that his order asserting such authority and purporting to direct the county attorney's legal opinions is unenforceable. The dispute began in April, when U.S. Immigration and Customs Enforcement requested documents from Gallatin County; Cromwell then filed her petition after Knudsen moved to direct her office's legal opinions directly, and the two sides ended up in court.
The core question is whether counties may provide confidential criminal justice information to ICE without a court order, and whether ICE counts as a criminal justice agency. The court has not yet ruled on that question; it ordered the parties to file briefs by December 7, 2026, after which it will decide whether counties may share such information with federal immigration authorities.
