Fast-Food Worker Who Photographed More Than 200 Customer Bank Cards Sentenced to Two and a Half Years in Florida

Marcus Bernard Clark, 30, of Fort Walton Beach, in Okaloosa County, Florida, was sentenced on November 6 to two and a half years in federal prison for photographing customers' bank cards while working at a fast-food restaurant. The sentence was announced by the U.S. Attorney's Office for the Northern District of Florida.

According to court documents, in September and October 2022, Clark worked at a Wendy's restaurant in Destin. During a judicially authorized extraction of Clark's cell phone related to another criminal case, law enforcement discovered more than 200 photographs and some short videos of different individuals' credit and debit cards. Investigators determined the photographs were taken at the Wendy's restaurant while Clark was working, and none of the victims had given him permission to photograph their bank cards, which bore their names and card numbers.

Clark had previously pleaded guilty to fraudulent possession of fifteen or more unauthorized access devices and aggravated identity theft.

U.S. Attorney John P. Heekin said the successful prosecution was made possible by the excellent investigative work of the Okaloosa County Sheriff's Office, and warned that those who seek to enrich themselves by preying upon and defrauding others will see the inside of a federal prison cell.

Okaloosa County Sheriff Eric Aden said his office takes crimes involving the theft of personal and financial information very seriously, and that investigators and their partners are committed to pursuing offenders and holding them accountable.
