Ninth Circuit Pauses Lower Court Ruling 2-1 on October 30: Idaho's Near-Total Abortion Ban Stays in Full Effect During Appeal
Idaho — The San Francisco-based U.S. Court of Appeals for the Ninth Circuit ruled 2-1 on October 30 to pause a federal judge's ruling, so Idaho's near-total ban on abortion remains in effect while the state's appeal proceeds.
The lower court had held the state law unconstitutional because it provides no exceptions for pregnancies that pose risks to women's health, and ordered Idaho to allow abortions where a doctor deemed it necessary to protect the mother's health; that ruling was subsequently limited to barring enforcement only against the plaintiff, Dr. Stacey Seyb.
The appeals court said Seyb is unlikely to prevail on claims that the U.S. Constitution protects a right to a health-saving abortion, noting that the Supreme Court, in overturning Roe v. Wade in 2022, stated there is no right to abortion under the Constitution.
Idaho Attorney General Raul Labrador applauded the ruling, saying the state's protection for unborn children and their mothers will continue as intended. The case remains on appeal, alongside separate litigation over whether a federal emergency-care law requires hospitals to provide abortions to stabilize patients in some circumstances despite Idaho's ban.
