GM to Pay $220 Million in Driver-Data Privacy Settlement With 36 States Covering Nearly 10.3 Million Drivers, Delaware Announces October 29
Delaware: Attorney General Kathy Jennings announced on October 29 that General Motors will pay $220 million to settle claims by 36 states that it illegally sold drivers’ behavior and location data.
According to the attorneys general, from 2016 to 2024 GM sold the driving behavior and location information of nearly 10.3 million drivers to third parties without consent, including data brokers who resold it to insurance companies. Its OnStar Smart Driver program also wrongly told more than 370,000 drivers they were not enrolled while their data continued to be collected and sold. Delaware will receive more than $4.7 million.
Delaware served on the settlement’s executive committee alongside Washington, Oregon, Colorado, Connecticut, Illinois, Kentucky, Maryland, Minnesota, New Jersey, Utah and Vermont. Beyond the payment, GM agreed to obtain consumers’ affirmative express consent before collecting or disclosing driving and location data, to limit the data it collects, and to accept oversight and dealership training requirements. Delaware residents can learn about their data privacy rights or file a complaint through the state’s consumer protection website.
