Construction Company Owner Arthur Nelson and Three Others Indicted in Wide-Ranging Tax and Financial Fraud Schemes
The Justice Department announced on October 26 that a federal indictment in the Eastern District of New York was unsealed charging construction company owner Arthur Nelson and three others — Joseph Free, Paul Vasquez and Ulysses Jude Devocion — in long-running tax and financial fraud schemes, including about $5 million in wages paid without withholding federal employment taxes and roughly $13 million in underreported business receipts; the case is being investigated by IRS Criminal Investigation.
The indictment alleges Nelson owned and operated glass installation and electrical companies including MTB AMG Inc., PAL AMG Inc., MTB Metal Fabricators Inc. and Wired NYC LLC, based in Brooklyn, New York, until March 2022 and in New Jersey afterward. From April 2017 to May 2024, the defendants allegedly paid employees weekly wages without withholding federal employment taxes — at least about $5 million in wages — and underreported the companies' gross receipts by about $13 million through false returns. From July 2019 to March 2025, Nelson and others allegedly submitted false financial documents to obtain loans, mortgages and credit lines, and Devocion is also charged with obstruction in connection with grand jury testimony.
The defendants, who live in Staten Island, New York; Sunny Isles Beach, Florida; Englishtown, New Jersey; and Queens County, New York, face charges including conspiracy to defraud the IRS, tax evasion, willful failure to withhold or pay over employment taxes, failure to file returns, aiding the filing of false corporate returns, FBAR violations and wire fraud conspiracy, with maximum penalties ranging from one year to 20 years per count. The case is part of the Justice Department's National Tax Fraud Enforcement Surge announced on October 26. The department noted that an indictment is merely an allegation and the defendants are presumed innocent until proven guilty.
