Follow-Up: Anaheim Man Formally Charged With Murder in Stabbing Death; Arraignment Scheduled for Oct. 27
The Orange County District Attorney's Office on October 27 formally charged Anaheim, California, resident Ismael Pinedalopez in the October 24 killing of 28-year-old Nicolas Garcia of Whittier, who was found in bed with Pinedalopez's wife and stabbed to death with a pocketknife after the defendant came home early from work. Pinedalopez faces one felony count of murder with a sentencing enhancement for the personal use of a weapon, and a maximum sentence of 26 years to life if convicted on all counts. The case, number 26NF5484, is being prosecuted by Senior Deputy District Attorney Mark Birney of the Homicide Unit.
The District Attorney's Office said Pinedalopez was scheduled to be arraigned on October 27. As of publication, the outcome of the arraignment and the next court date had not been announced; GSM will continue to follow the case.
"Violence is never the answer, and it is truly heartbreaking that these young children had to witness their father commit such a horrific act of brutality in their own home," Orange County District Attorney Todd Spitzer said in the charging announcement. Garcia was in his underwear in bed with the defendant's wife and the couple's two young children — a 2-year-old daughter and a 4-year-old son — when he was attacked on October 24; the wife and children were not hurt, and Pinedalopez was arrested at the scene. The charges are allegations, and Pinedalopez is presumed innocent unless convicted in court.
