Follow-Up: Six Citizens Sue Trump Administration, Saying White House Press Bans Violate the Public's First Amendment Rights
Six American citizens sued President Donald Trump and several administration officials in the U.S. District Court for the Southern District of New York on October 26, arguing that the White House's bans on CNN, MS NOW and Politico from the White House and Air Force One violate the public's First Amendment right to receive information about its government, and asking the court to declare the bans unconstitutional and block their enforcement. According to USA Today and The Washington Post, the suit was filed by the Knight First Amendment Institute at Columbia University and Yale Law School's Media Freedom and Information Access Clinic.
The six plaintiffs are Yale law professor Kenneth Roth, Yale history professor Beverly Gage, Lawfare editor-in-chief Benjamin Wittes, journalist Daniel Froomkin, Ethan Young, editor-in-chief of the University of Pennsylvania's student newspaper, and Peter Schmidt-Nowara, a New York City high school teacher. The complaint says the bans have harmed each plaintiff's work: Froomkin is deprived of reporting he uses to evaluate and write about the president and his policies, while Gage relies on White House press corps reporting for her scholarship, public writing and teaching. 'The ultimate injury here, however, is to the democratic republic,' the complaint says. The defendants, in addition to Trump, include White House spokesman Steven Cheung, Secret Service Director Sean Curran and White House Chief of Staff Susie Wiles.
The new suit continues the same fight over White House press access: after CNN, MS NOW and Politico were barred from the White House in September, the three outlets sued, and a federal judge in October extended a preliminary injunction allowing them to keep entering the White House while the litigation proceeds, with the government appealing (as GSM reported on October 14). The new complaint also cites the administration's 2025 effort to bar the Associated Press from certain spaces and the October 20 decision to block a reporter from The Independent from Air Force One after Trump called him a 'sick person,' arguing the bans' effects reach far beyond the three named outlets.
The two sides offered opposing accounts. Katie Fallow, deputy litigation director at the Knight First Amendment Institute, said in an October 26 statement: 'The White House cannot decide what information Americans receive by punishing critical reporting.' She said that when the White House expels reporters over their coverage and threatens others, 'it isn't just the press that suffers — the public loses access to independent reporting.' A White House official responded to USA Today by email the same day: 'No person may demand access to the Oval Office,' adding that media outlets that 'pedal misinformation and defamation are completely capable of reporting their manufactured stories from directly outside.' The Justice Department, which represents the government, did not respond to a request for comment. Further proceedings await the court's schedule.
