Minnesota appeals court rules Oct. 26: six theft convictions in Medicaid fraud case must be reinstated
St. Paul, Ramsey County, Minnesota — The Minnesota Court of Appeals ruled on Oct. 26, reversing a district court's post-verdict acquittal in a Medicaid fraud case, remanding the case and ordering the jury's six guilty verdicts reinstated. The case centers on Promise Health Services, a Medicaid services agency Yusef and his wife opened in 2018, first registered in Burnsville and later moved to an address on Central Avenue in Minneapolis. When investigators searched the address in 2022, they found the agency was in fact using only a mailbox rather than a physical office, and that its records were mixed with those of other providers, including businesses connected to Yusef's family. Minnesota charged Yusef in June 2024 with racketeering and six counts tied to fraudulent billing from October 2019 to August 2022. After a seven-day trial, the district court dismissed the racketeering count before jury deliberations; the jury then convicted on all six theft counts and found aggravating factors, but the district court later overturned those verdicts. On Oct. 26 the appeals court held that the circumstantial evidence in the record was sufficient to support the six convictions for aiding theft.
