Maricopa County Restores Voting Rights of 25 Voters Wrongly Flagged as Noncitizens Ahead of November 3 Election
Maricopa County Recorder Justin Heap has agreed to fully reinstate the voter registrations of 25 voters who had been wrongly flagged as noncitizens, and Arizona Attorney General Kris Mayes announced a settlement of her lawsuit over the matter. The 25 voters had been marked "not eligible" after being flagged by the federal Systematic Alien Verification for Entitlements (SAVE) database, putting their ability to vote in the November 3 general election at risk.
The dispute began when Heap screened about 61,681 voters with the database earlier this year and referred 207 people to prosecutors, 60 of whom had previously cast ballots. The Maricopa County Attorney's Office found that only 8 of those 60 were actually noncitizens and the remaining 52 were U.S. citizens. Mayes sued over the 25 citizen voters still marked ineligible.
After court mediation on October 23, the two sides reached agreement: Heap's office restored the voters' full registration status, and those on the early voting list will be mailed ballots so they can vote normally on Election Day.
