Follow-up: Justice Department Writes to at Least 18 California Counties: Verify Suspected Noncitizen Voters and Set Aside Their Ballots Within 48 Hours
WASHINGTON — The U.S. Justice Department on Friday, October 23, wrote to California county election officials asking them to work with the department and the Department of Homeland
Security to "identify who on the accompanying list is a citizen and who is not," and to provide related information within 48 hours and set aside mail-in ballots whose voters' citizenship cannot be confirmed. At least 18 counties received similar letters, CBS News reported, citing the Los Angeles County registrar.
First Assistant U.S. Attorney Bill Essayli wrote to San Bernardino County officials: "If persons knowingly tabulate ballots cast by individuals identified by federal agencies as noncitizens, they risk becoming aiders and abettors to a federal crime." The letters ask counties to provide identifying information for suspected noncitizen voters and to sequester ballots where citizenship cannot be verified.
The dispute traces to an October 13 letter from the Justice Department to Los Angeles County and California Secretary of State Shirley Weber, which included a password-protected thumb drive containing names of people the administration "believes are likely non-citizens" who had been sent ballots for the November election, with a 48-hour review demand and a threat to seek "emergency relief." On October 15 the department sued California and Los Angeles County seeking to block counting of more than 20,000 mail-in ballots associated with people it describes as likely noncitizens; GSM reported on October 22 that the department had filed a notice of appeal with the U.S. Court of Appeals for the Ninth Circuit, arguing that the trial judge's failure to rule by its deadline amounted to a "constructive denial." On Friday the department asked the Ninth Circuit to intervene before next week's hearing, arguing that "every minute of processing that occurs without segregating the ballots of suspected ineligible voters causes untraceable disenfranchisement and dilution of the votes of United States citizens." Fox News reported that the Ninth Circuit has ordered California to respond by noon on Saturday.
Los Angeles County Clerk Dean C. Logan wrote to the California Association of Clerks and Election Officials on Friday, calling the latest letter a "posture of intimidation and threats leveled against local election officials just twelve days before the election," and saying the 48-hour deadline was "unenforceable" because the information had previously been obtained through subpoenas.
Logan said a county review of the department's 20,000-name list showed many entries "were associated with addresses throughout California, not solely within Los Angeles County." California Senator Alex Padilla responded on Friday that the department "has not provided any evidence for their claims of massive voter fraud," that its data had been admitted to be "inaccurate and unreliable," and that the federal government "does not have the authority to interfere" in California elections.
The reliability of the department's list is at the heart of the dispute: GSM's October 22 report noted that Los Angeles County said its portion of the list covered only 7,035 addresses, including duplicates and cancelled registrations, and that in a county sample of about 200 people, 25.8% of flagged voters' records showed a U.S. place of birth. The November 3 midterm election is already under way. (GSM, from CNN, October 24; the Ninth Circuit response deadline as reported by Fox News)
