英国高等法院裁定：钱志敏案6.1万枚比特币归属索赔须按中国法律审理 受害人一方已着手上诉

英国伦敦高等法院10月12日作出一项先行裁定：在钱志敏案中被伦敦警察厅查扣的6.1万枚比特币，其归属索赔须按中国法律而非法官所在的英国法律审理。法官 Mark Turner 在判决中指出，涉案投资合同的订立、受害人付款与比特币买入都发生在中国，损害的直接后果也在中国发生，因此受害人对这批比特币是否享有财产性权利，应由中国法律判定。

这批比特币现值约38亿英镑（约50亿美元），是伦敦警察厅在调查钱志敏洗钱案时查扣的。钱志敏通过天津蓝天格锐电子科技有限公司在2014年至2017年间运作投资骗局，受害投资者超过12.8万人；她将骗得的资金兑换成比特币后于2017年逃往英国，2025年11月在英国承认洗钱罪、被判处11年8个月监禁。

本次裁定并不决定比特币最终归谁。英国皇家检察署表示，后续听证将逐一审查申请人能否证明对比特币享有权益；据英国《金融时报》报道，代表受害人的 Fieldfisher 律师事务所正推进上诉。法院今年3月的一份命令显示，已有2594名申请人依据《犯罪收益法》第281条提出主张。财新此前报道称，参与英国追索程序的中国受害人约1.6万人；按中国法律口径，受害人可主张的通常是本金与利息，而非比特币多年升值后的现值。

钱志敏买入比特币的均价约为每枚2815元人民币，如今单枚价格约为当时的约200倍。这批资产的最终分配，将取决于上诉结果与后续听证对中国法律具体内容的认定。

UK High Court Rules Chinese Law Governs Victims' Claims to 61,000 Bitcoin Seized in Qian Zhimin Case

In a preliminary judgment handed down on October 12, the High Court in London ruled that ownership claims to the 61,000 bitcoin seized by the Metropolitan Police in the case of Qian Zhimin must be assessed under Chinese law rather than English law. Mr Justice Turner held that the investment contracts, the investors' payments and the bitcoin purchases all took place in China, and that the immediate economic consequences of the alleged fraud were suffered in China.

The seized bitcoin are now worth about 3.8 billion pounds (about $5 billion). Qian ran investment schemes through Tianjin Lantian Gerui Electronic Technology between 2014 and 2017 that defrauded more than 128,000 investors; she converted the proceeds into bitcoin and fled to the United Kingdom in 2017. In November 2025 she pleaded guilty to money laundering in the U.K. and was sentenced to 11 years and eight months in prison.

The ruling does not decide who ultimately keeps the bitcoin. The Crown Prosecution Service says a further hearing will determine whether any victims can establish an interest in the coins, and according to the Financial Times the claimants' lead law firm, Fieldfisher, is pursuing an appeal. A court order in March 2026 listed 2,594 applicants claiming under section 281 of the Proceeds of Crime Act. Caixin has reported that about 16,000 Chinese victims are participating in the U.K. recovery process; under a Chinese-law analysis, victims would generally be limited to recovering principal and interest rather than a share of the bitcoin's appreciation.

Qian bought the bitcoin at an average price of about 2,815 yuan per coin; the price has since risen roughly 200-fold. The final distribution of the seized assets will depend on the appeal and on later hearings on the content of Chinese law.
