Sia Granted Primary Physical Custody of 2-Year-Old Son as Divorce from Dan Bernad Continues
According to court documents obtained by PEOPLE, Judge Firdaus Dordi has granted Australian singer Sia, 50, primary physical custody of Somersault, the 2-year-old son she shares with her estranged husband Dan Bernad, based on an agreement between the former couple. Bernad maintains shared legal custody and visitation, with holidays and other special days outlined in the agreement. TMZ was first to report the news, and representatives for Sia and Bernad did not immediately respond to PEOPLE's request for comment.
The pair's divorce remains ongoing. Sia filed for divorce in March 2025; the two married in 2022 and welcomed their son in March 2024. The former couple had previously reached an agreement on child support: under filings in Los Angeles County Superior Court, Sia agreed to pay Bernad $42,500 per month beginning April 1, continuing until their son turns 18, or, if he is still attending high school full-time, until he graduates or turns 19. She also covers private school tuition, agreed extracurricular activities and uninsured healthcare costs, maintains health insurance for her son, and must keep a $5 million life insurance policy naming him as beneficiary or an equivalent trust. After the support agreement became public, Sia posted on X that she is "a sober working mom trying to buy peace," saying she has primary custody of their son and is the only parent earning income.
The custody arrangement had earlier been contested. In October 2025, Bernad sought sole legal and physical custody, alleging in court filings that Sia was "an unfit and unreliable parent struggling with substance abuse and addiction." Sia responded the following day that she had been sober for more than six months and was in a recovery program with weekly testing and a sober companion, calling her recovery "a cornerstone of my life." A judge later denied Bernad's request for emergency sole custody, finding that sufficient exigency for the emergency relief had not been shown at that time.
