Actor Halle Berry and her ex-husband Olivier Martinez faced off in a custody hearing on October 19 in Los Angeles County Superior Court, where their 13-year-old son Maceo testified for hours, according to Page Six; the hearing was not concluded and is set to resume at 10:30 a.m. on Tuesday, October 20.

Martinez obtained a temporary domestic-violence restraining order on October 1: he alleges Berry choked Maceo during a September 26 dispute over a VR headset and claims several similar incidents over the past year and a half; he is seeking sole legal and physical custody. His attorney Patrick Baghdaserians told Page Six that Martinez is 'a great, loving father who wants the best for his son.'

Berry firmly denies the allegations: her lawyer has called them 'entirely meritless and deliberately misleading.' She is seeking to have the restraining order dismissed, to restore the 50/50 custody arrangement and joint decision-making on education and therapy, and alleges Martinez has interfered with their son's educational therapy and turned the boy against her.

Nahla, Berry's 18-year-old daughter with Gabriel Aubry, has been listed as a potential witness and may testify by video; in an earlier court declaration she said she had never seen her mother 'hit, slap, choke or grab' Maceo. Berry's fiancé Van Hunt is also a potential witness. Berry and Martinez married in 2013, separated in 2015, and finalized their divorce only in August 2023.
