加州新法:1964年前成立的百年大企业须自查并公开与奴隶制的历史关联

加州州长纽森9月30日签署AB 2599号法案《真实披露法案》(Truth in Disclosure Act),使其成为法律。新法要求:凡在1964年12月之前已经存在(或其前身当时已存在)、且全球年营收超过1亿美元的公司,必须自查历史档案,并在伪证处罚之下提交宣誓声明,披露自身或前身是否曾从奴隶制中获利。

保险业界指出,加州在2000年已有法律要求保险公司披露奴隶制时期的保单;也有批评者认为,在企业本就掂量营商成本的当下,新法会再添一层合规负担。

California Law Requires Large Pre-1965 Companies to Disclose Historical Ties to Slavery

California Governor Gavin Newsom on September 30 signed AB 2599, the Truth in Disclosure Act, into law. The measure requires companies that existed — or whose predecessors existed — on or before December 1964, and that take in more than $100 million in annual worldwide gross receipts, to search their own records and file sworn affidavits, under penalty of perjury, disclosing whether they or their predecessors profited from slavery.

The first filings are due January 15, 2029, and will feed a public, searchable database run by the state Civil Rights Department, which must be built within a year after lawmakers fund it. The law grew out of the reparations task force Newsom created in 2020, whose 2023 report carried more than 100 recommendations. According to CalMatters, it is the first law of its kind in the nation.

Insurers note that a separate California law from 2000 already required disclosure of slavery-era insurance policies, while critics warn the new measure adds another layer of compliance costs for businesses weighing where to operate.
