Labor Department Proposes $648,094 in Penalties Against Six New York, New Jersey Construction Employers

The U.S. Department of Labor announced on May 12 that the Occupational Safety and Health Administration (OSHA) has cited six construction employers in New York and New Jersey for willful and serious safety violations at a Monroe, New York development site, proposing combined penalties of $648,094 - 23 serious and five willful violations. The project, Monroe Commons (also known as the Magna Square development), is a planned four-story, roughly 408,000-square-foot mixed-use commercial building with retail, office space and a 39-room hotel on 18 acres. OSHA said a nearly 75-foot-high steep, unstable earthen bank at the site was not adequately sloped or shored. General contractor Advanced Plan and Build LLC and subcontractors Parkstone Inc. and Obstacle Systems Inc. (operating as Drip Drop Waterproofing Inc.) and The Paving Masters LLC were cited willfully for exposing employees to cave-in and struck-by hazards at the unprotected excavation; Advanced Plan and Build and The Paving Masters were also cited willfully for failing to have excavations 21 to 75 feet deep designed by a registered professional engineer as required. Century Max Industries Corp., DelValle Contractor and Prime Structure Inc. were cited seriously for cave-in and struck-by hazards, and DelValle and Parkstone/Obstacle additionally for fall-protection and chemical hazards. Proposed penalties: Parkstone/Obstacle $198,615; The Paving Masters $188,684; Advanced Plan and Build $175,444; Century Max Industries $46,340; Prime Structure $19,860; DelValle Contractor $19,151. Employers have 15 business days from receipt of the citations to comply, request an informal conference with OSHA's area director, or contest the citations before the independent Occupational Safety and Health Review Commission.
