DHS: New York Has Declined 16,070 ICE Detainers Tied to 52,503 Criminal Charges and Convictions
The U.S. Department of Homeland Security released data on October 12 showing that between January 20, 2025, and October 8, 2026, authorities in New York State declined to honor 16,070 detainer requests issued by U.S. Immigration and Customs Enforcement (ICE), involving people associated with a combined 52,503 criminal charges and convictions. A detainer asks a local jail to hold a person for up to 48 hours beyond their scheduled release so that federal agents can take custody.
According to DHS, the charges and convictions include 131 related to homicide, 132 to kidnapping, 1,017 sexual offenses, 9,502 assaults, 4,324 dangerous-drug offenses, 2,198 weapons offenses, 1,776 robberies, 1,631 burglaries and 1,561 DUIs. Homeland Security Secretary Markwayne Mullin criticized New York City Mayor Zohran Mamdani and Governor Kathy Hochul in the statement, saying federal officers will continue enforcing the law without local help. DHS linked the data release to an ICE operation in New York City last week in which, according to the department, a man drove his vehicle at officers and an officer fired in self-defense.
Governor Hochul's office responded that the state notifies federal authorities of noncitizens serving state prison sentences and called the DHS characterization a misrepresentation. Hochul signed legislation in May 2026 restricting local law-enforcement cooperation with ICE; the law took effect in late August.
