On Indigenous Peoples' Day, Hobbs and Arizona Tribal Leaders Oppose Federal Rollback of Historic Preservation Review
PHOENIX — On Indigenous Peoples' Day, Oct. 12, Arizona Gov. Katie Hobbs and tribal leaders across the state sent a joint letter to the President's Advisory Council on Historic Preservation (ACHP), calling on the council to withdraw a proposed federal rule change and conduct meaningful consultation with states and Tribal Nations.
For the last 60 years, Section 106 of the National Historic Preservation Act has required federal agencies to consider the effects of their actions on cultural and historic places before funding, permitting or building a project, giving states and tribal governments a voice in decisions that affect them. In July, the ACHP advanced a near-complete rewrite of the implementing rules that would remove state and tribal input and limit federal review to areas physically or directly affected by a project — meaning tribal concerns about visual and atmospheric effects on cultural landscapes and sacred sites would no longer be taken into account.
"We should work to protect our treasured landmarks and cultural heritage for future generations," Hobbs said, adding that the proposed revisions would needlessly harm Arizona's ancestral sites. Hualapai Tribe Chairman Duane Clarke called the changes unprecedented and unnecessary, warning they could fast-track projects that destroy tribal resources and lands forever.
