工业富联、立讯精密遭美国337调查 涉数据中心“垂直供电”专利 两家称无实质影响
据《每日经济新闻》《中国基金报》报道，美国国际贸易委员会（ITC）10月9日发布公告，决定对特定数据中心垂直电源输送系统及其组件启动337调查，案件编号337-TA-1526。调查基于美国Vicor公司9月8日提出的申请：Vicor指控相关产品侵犯其美国第10,903,734号专利权，请求ITC发布有限排除令和停止令。
被列名为调查对象的包括：立讯精密美国公司、鸿海集团旗下的鸿佰科技美国公司、台达电子美国公司、广达电脑美国公司、英飞凌美国公司，以及中国内地的立讯精密工业股份有限公司（002475.SZ）。337条款是美国《1930年关税法》第337条，因应诉成本高、程序快被业内称为美国市场的“生死条款”：一旦认定侵权，产品可能被禁止进入美国市场。
券商中信建投就此向两家公司核实，双方均回应称无实质影响：立讯精密表示，公司已第一时间聘请外部律师核查，涉诉专利对应的产品尚处于客户验证阶段，尚未正式出货，未对经营产生影响，公司坚持合规经营、尊重知识产权并严格自查；工业富联（601138.SH）表示，经核实其数据中心产品设计始终坚持自主创新，相关业务不涉及本次调查内容，初步评估对公司经营及财务无实质性影响，并称将与全球主要客户完成官方送达环节的解释说明。工业富联2026年上半年营收5578.61亿元、归母净利润178.51亿元，两项均创历史新高，云计算业务收入同比增长超2倍，中国内地云服务商AI服务器业务增速惊人。数据显示，中国对外投资存量结构中，制造业、信息传输与软件信息技术服务业占比分别达14.5%和9.8%，是中国企业出海的主要赛道——随着中企在AI算力产业链的份额提升，海外知识产权摩擦正成为出海企业的常态变量。（综合《每日经济新闻》《中国基金报》报道）
Foxconn Industrial Internet and Luxshare Face U.S. Section 337 Probe Over Data-Center Power Patent
The U.S. International Trade Commission (ITC) voted on October 9 to institute a Section 337 investigation into certain data-center vertical power delivery systems and components, case No. 337-TA-1526, based on a complaint filed September 8 by Vicor Corporation alleging infringement of U.S. Patent No. 10,903,734 and seeking a limited exclusion order and cease-and-desist orders.
Named respondents include Luxshare Precision's U.S. unit, Hongbai Technology (a Foxconn affiliate) in the U.S., Delta Electronics Americas, Quanta Computer's U.S. arm, Infineon Technologies Americas, and China's Luxshare Precision Industry (002475.SZ). Both Chinese groups said there would be no material impact: Luxshare said the product tied to the patent is still in customer validation and has not shipped; Foxconn Industrial Internet (601138.SH) said preliminary assessment shows no material effect on operations or finances. Section 337 cases under the Tariff Act of 1930 can result in exclusion of products from the U.S. market and are widely seen as a fast, high-stakes trade remedy.
