Nevada Governor Lombardo Suspends Red-Dyed Diesel Enforcement, Aligning with Trump Executive Order

Nevada Governor Joe Lombardo announced on October 10 that he has directed the Nevada State Police–Highway Patrol to suspend enforcement of the state's red-dyed diesel restrictions on public highways, implementing temporary federal relief for farmers and truckers. The governor's order is contingent on the IRS not imposing penalties when dyed diesel is used under the President's executive order.

Any administrative fines incurred during the period covered by the federal order will be waived by the Director of the Nevada Department of Motor Vehicles under her statutory authority. The enforcement suspension will continue for a sufficient period after the federal order expires, allowing residual red dye in fuel systems to dissipate to undetectable levels so drivers are not penalized.

“Nevada will do its part to implement President Trump's executive order and ensure our state's enforcement practices align with federal guidance,” said Governor Lombardo. “We want to give Nevadans the opportunity to take advantage of this temporary relief without fear of being penalized for complying with the order.”

President Trump's executive order, signed October 5, 2026, temporarily expands the permitted highway use of red-dyed diesel and provides certain tax relief and penalty protections through December 31, 2026 — federal relief aimed at record-high diesel prices during the harvest season.

Nevada joins a growing list of states adjusting dyed-diesel enforcement this fall, including Montana, Missouri, Mississippi, Tennessee, South Dakota, Nebraska and Colorado, as governors seek to cut transportation costs during the 2026 harvest.
