DOJ Updates Emergency Scheduling Action for 7-OH, With Threshold Approach
The U.S. Department of Justice announced on Oct. 9 that the Drug Enforcement Administration will issue new Notices of Intent for 7-OH and related opioid substances. The update follows revised scientific advice from the Department of Health and Human Services, aimed at distinguishing trace amounts that may occur in botanical material from products intentionally enhanced or concentrated.
According to DOJ, HHS recommended Schedule I control when the substances exceed 1 milligram per gram in solid products or 1 milligram per milliliter in liquid products, or when the relevant ratio falls below 100 to 1. DOJ also said MGPI, MGM-15 and MGM-16 were temporarily placed in Schedule I on Aug. 26, 2026, and those controls remain in effect during the new notice period and until DEA issues a new temporary scheduling order.
