Judge Blocks Illinois From Imposing Sportsbook Rules on Prediction Markets
CHICAGO — A federal judge ruled Oct. 7 that Illinois cannot impose its sportsbook regulations on prediction markets, finding state gambling law conflicts with federal law governing the federally regulated platforms, NPR Illinois reported.
U.S. District Judge Mary Rowland of the Northern District of Illinois ruled in favor of prediction market companies that sued Illinois regulators, arguing the state's attempt to license and regulate them like sportsbooks is preempted by federal law. Prediction markets — including platforms like Kalshi, Robinhood and Crypto.com — are regulated at the federal level by the Commodity Futures Trading Commission under the Commodity Exchange Act, which the judge found gives the federal government exclusive jurisdiction over the derivatives they offer.
Illinois is one of the nation's largest sports betting markets, with licensed sportsbooks taking billions in wagers each year and generating hundreds of millions in tax revenue. State regulators had sought to bring prediction markets under the same rules that apply to licensed sportsbooks, including licensing fees, tax rates and consumer protections.
The prediction market companies argued they are fundamentally different: their event contracts are financial derivatives overseen by a federal regulator, not wagers overseen by state gaming boards. Judge Rowland agreed, finding the state rules an obstacle to the federal regulatory scheme.
The ruling, reported Oct. 8, is the latest in a nationwide legal battle between state gambling regulators and prediction market operators over whether event contracts on sports outcomes are gambling or federally regulated derivatives. Similar cases are pending in several other states, and legal experts said the Illinois decision could influence courts nationwide.
