纽森签署AB 1657:加州统一家暴临时保护令申请规则

加州州长加文·纽森(Gavin Newsom)于2026年9月20日签署AB 1657。该法案涉及家庭暴力临时限制令的申请程序,签署后成为适用于全加州的州法律,并非仅限于索诺玛县。
AB 1657由索诺玛县家庭司法中心(Family Justice Center Sonoma County)推动,加州众议员Chris Rogers提出。法案获得加州州议会通过后,由州长签署成为法律。
根据法案文本,当申请人向法院申请家庭暴力单方临时限制令(ex parte restraining order)时,法院不得要求申请人在法院受理申请或作出决定前,提前通知拟被限制方;法院也不得要求申请人提交说明或声明,解释为何没有提前通知对方。
同时,法院不得仅以申请人未提前通知拟被限制方为理由,全部或部分驳回单方临时限制令申请。各地法院也不得制定或继续采用与上述规定相冲突的地方规则、表格或办事程序。
法案还规定,如果申请人使用加州司法委员会规定的必填表格,提交了签发保护令所需的全部文件,并清楚列明申请人与拟被限制方的身份,法院书记员不得拒绝接收申请。
新法主要针对临时限制令的初始申请阶段,目的是统一加州各县法院的受理标准,减少申请人在寻求紧急司法保护时可能遇到的程序障碍。该规定并不代表法院自动批准保护令,法院仍须根据申请材料和相关法律标准作出决定。
此外,“无需提前通知”不等于拟被限制方永久失去知情权或陈述权。临时命令签发后的送达、正式听证以及是否签发较长期保护令,仍须依照加州法律规定的后续程序进行。
AB 1657修改的是《加州家庭法典》相关条款,因此适用于加州各县法院。尽管法案最初由索诺玛县家庭司法中心推动,但它不是索诺玛县的地方规定,而是一项全州性法律。
按照加州一般立法生效规则,AB 1657将于2027年1月1日生效。

Newsom Signs AB 1657, Unifying DV Restraining-Order Rules Statewide
Gov. Gavin Newsom signed AB 1657 on Sept. 20, 2026, a bill governing applications for domestic-violence temporary restraining orders. It is now state law applying across California — not limited to Sonoma County.
AB 1657 was championed by the Family Justice Center Sonoma County and authored by Assemblymember Chris Rogers. After passing the Legislature, it was signed into law by the governor.
Under the bill, when an applicant seeks an ex parte domestic-violence restraining order, courts may not require advance notice to the restrained party before accepting or deciding the application, nor demand a written explanation for why notice was not given.
Courts also may not deny an ex parte application in whole or part solely because the applicant did not notify the other party in advance. Local courts may not adopt or keep rules, forms or procedures conflicting with these requirements.
The bill further provides that if an applicant uses the Judicial Council's mandatory forms, submits all required documents and clearly identifies both parties, the court clerk may not refuse to accept the filing.
The law targets the initial application stage, aiming to standardize intake across county courts and reduce procedural barriers for people seeking emergency protection. It does not mean automatic approval — courts still decide based on the filings and legal standards.
"No advance notice" does not permanently strip the restrained party of notice or a chance to be heard; service, the formal hearing and any longer-term order still follow California's prescribed procedures.
AB 1657 amends the California Family Code and therefore binds courts statewide. Though initiated by Sonoma County's Family Justice Center, it is a statewide statute, not a local rule.
Under California's default effective-date rule, AB 1657 takes effect Jan. 1, 2027.
