8th Circuit Halts Minnesota's Anti-Nudification Law After xAI Wins Injunction
ST. LOUIS — The U.S. Court of Appeals for the Eighth Circuit, sitting in St. Louis, ruled Oct. 4 in favor of Elon Musk's xAI, halting enforcement across Minnesota of a law banning AI-generated fake nude images. It is the first court pause for the nation's first "nudification" law, which took effect Aug. 1.
The law prohibits knowingly disseminating AI-generated fake nude images that the depicted person never actually made. xAI sued, calling the law unconstitutional and seeking to block it; the Minnesota Attorney General's office defended the statute. Last month, U.S. District Judge Donovan Frank denied xAI's request for emergency relief; on Friday, the Eighth Circuit reversed that decision and granted a temporary injunction.
The Minnesota Attorney General's office said it was disappointed by the ruling and would continue to defend the law. Minnesota lawmakers pushed the legislation in response to the spread of AI-generated sexual imagery on social media, particularly cases involving teenage victims.
The court did not rule on the law's ultimate constitutionality. The case returns to the district court, where the state is expected to seek an expedited process to restore the ban.
