新泽西州独立承包商ABC测试10月1日生效，企业用工分类趋严
【特伦顿讯】10月1日起，新泽西州判定劳动者是雇员还是独立承包商的 ABC 测试标准正式生效。据行业媒体报道，这一被称为全美最严格的分类标准之一的新规，将直接影响建筑、货运、零工经济等大量依赖独立承包商的行业。
ABC 测试要求企业证明三点才能将劳动者归为独立承包商：劳动者不受企业控制；所从事的工作超出企业常规业务范围；劳动者独立从事同类业务。三项缺一不可，否则即被认定为雇员，企业须承担失业保险、工伤保险等雇主义务。
支持者认为，新规能遏制企业通过错误分类逃避社保与劳工保护；反对的商界团体则担心，中小企业与自由职业者将面临更高的合规成本与诉讼风险。
新泽西州劳工厅表示，将发布执法指南并设立过渡期咨询，帮助企业完成用工分类自查。

New Jersey's ABC Test for Independent Contractors Takes Effect
[TRENTON] New Jersey's ABC test for classifying workers as employees or independent contractors took effect October 1, industry media reported. The standard — considered one of the strictest in the nation — will directly affect construction, trucking, gig-economy and other sectors that rely heavily on independent contractors.
Under the ABC test, a business must prove three prongs to classify a worker as a contractor: the worker is free from the company's control; the work performed is outside the company's usual course of business; and the worker is independently engaged in the same trade. Failing any prong means the worker is an employee, obligating the business to cover unemployment insurance, workers' compensation and other employer duties.
Supporters say the rule curbs misclassification used to dodge payroll taxes and labor protections; business groups counter that small firms and freelancers face higher compliance costs and litigation risk.
The state Department of Labor said it will issue enforcement guidance and offer transition-period consultations to help businesses audit their worker classifications.
